Medical Marijuana Affecting Child Custody Disputes

While case law is still young regarding the effects on child custody disputes when one parent is using medical marijuana, the early results show that parents using the drug are at an initial disadvantage. Although its been more than 10 years since states began legalizing the use of marijuana for medical purposes, the effects that the legalization has had on the family law judicial system has been slow. For the most part, judges, arbitrators and attorneys appointed ad litems for children still consider a parent’s medical use of the drug as a negative.
This is true despite some states even writing in its family law code that parents should not be penalized for the medical use of marijuana in a child custody dispute. For example, Michigan and Maine specify that patients won’t lose custody or visitation rights unless the patient’s actions endanger the child or are contrary to the child’s best interests.
It’s been shown in child custody battles that courts will generally side with the parent that keeps their child away from drugs. Medical marijuana activists in several states, including Washington, California and Colorado, say they’ve been getting more inquiries from patients wrapped up in custody-divorce cases in recent years as the number of people who use medical marijuana increases.
